hi,
having been on the panel where this "address" was first delivered, i've
had time to consider it, and i think its all bollocks (i hope i spelled
that right, i don't have my sex pistols album handy). i quite clearly
voiced my opinions on that panel at the gugg, and for those not able to
attend, i'll summarize them here. i get a little hot under the colar
about this, and its not a personal attack on jon ippolito, i just think
he is a bit misguided, and didn't think things through. remember, he
represents the guggenheim so his statements carry a certain amount of
weight.

first, why is it that we need a bureucratic organization to help us give
our art away for free? i do it quite well all on my own. i assume that
the "creative commons" will have employees that get paid, poorly or
well, to maintain its organization. the museums certainly have
employees, like jon himself, who get paid to show art. so once again,
the only person in the chain that is not getting paid is the artist.
business as usual.
second, the only alternative that jon presents to the artist as far as
making a buck is, get a day job. here's a quote from the rhizome list,
by fred nardo, that puts the situation in no uncertain terms:
'That it is couched in the terms "as
their parents, and grandparents did"
[quoting jon ippolito] is nothing
short of monarchistic. You are born
into your lot in life and should do
nothing to change it, so says the
Guggenheim.'
the real irony of the situation is that jon has a pretty darn good day
job, where the thing that i am most qualified to do in the current job
market is write sex phone telephony applications. not a bright prospect.
third, how does jon expect good art to be produced in an artist's spare
time, if they are holding down a day job? does this mean that net art
should only consist of one-liners and the equivalent of a
"non-commercial advertising?"
fourth, are we honestly concerned that our copyrights will be violated?
do we really believe that some commercial concern is gonna rip off our
work and make a profit when we can't even seem to sell much of it
ourselves? as fred nardo points out on rhizome, the only entity that
seems to benefit by this is the museum. they can pull from the commons
and display at will, yet they still charge admission to the museum. they
are relieved of the onus responsibility of paying the artist, and they
protect *themselves* from being sued for copyright infringment. the only
context my work exists in is the artworld context, nobody is gonna make
a copy of glasbead, call it theirs, and show it in moma. i'm simply not
concerned.
furthermore, the "ecosystm" commission i did last year (for which i was
well paid for) has the backing of a giant financial institution behind
it. if someone where to violate my (and their) intelectual property
rights in regards to that piece, watch out! i quote the CEO of ZCM: "we
will protect our intellectual property rights with zeal." i think that
statement is far more reassuring than having a not-for-profit
organization behind me, harvard grads or not. also specific to ZCM, my
agreement is very loose. i can show ecosytm where ever and when ever i
want, i can add to it, and sell 'em upgrades. the only thing i can't do
is sell the piece to someone else. so what! i can only sell a painting
once!
fifth, after canceling 13 net art commissions, leaving a number of
artists in a financial bind, they present as the solution a gift
economy? oh sorry artists, we just realized that this work shouldn't be
paid for in the first place, so don't feel bad that you just spent 7k on
new equipment for the commission, because its so much better to give
than recieve.
i think the approach outlined in jon's essayt sets a bad precedent, it
relieves the museum of all responsibility to the artist and to the
preservation of the work. it stands to benefit the institution most, and
the artist least.
